Using Nyamly
Nyamly's core features — barcode scanning, food search, manual logging, water and weight tracking — are free to use. Nyamly Pro is an optional auto-renewable subscription (monthly or annual) that raises the limit on AI photo/text estimates; its price and terms are shown before purchase and it is billed through your Apple ID account. By using the app you agree to these terms.
Nutrition information is a reference, not a guarantee
Calorie, macro and product data shown in the app comes from third-party databases (Open Food Facts, CIQUAL, CoFID, USDA FoodData Central, MenuStat) and from manufacturer-submitted barcode data. Nyamly does not independently verify every entry and cannot guarantee it is complete, current or error-free. Where data is missing, the app shows it as missing rather than substituting a value.
Nyamly's own score, and the Nutri-Score shown separately
The 0-100 score and Bad/Poor/Good/Excellent rating shown in the app is Nyamly's own calculation, based on the published UK Nutrient Profiling Model applied to the product's declared nutrients. It is Nyamly's reading of that model, not a claim of medical or nutritional authority.
Where a Nutri-Score grade is shown, that value is computed and published by Open Food Facts from the product's declared nutrients — not supplied by the manufacturer, and not calculated by Nyamly. It can differ from any grade printed on the physical package and may be wrong or missing.
AI estimates
"Estimate with AI" lets you get an estimated dish name, weight, calories and macros from a meal photo or a typed description, using a third-party AI service. Estimates are approximate and may be inaccurate; review them before logging. Availability and any daily or monthly limits are shown in the app.
No medical advice
Nyamly is a general food-logging tool. It does not diagnose, treat or provide medical advice. Consult a qualified professional for medical or dietary guidance specific to you.
Acceptable use
Don't use Nyamly to violate applicable law or to interfere with the service (for example, by attempting to bypass rate limits or overload the backend). Food data in the app is sourced under open licences — see Data sources & licences for what those licences permit.
Eligibility
Nyamly is rated 18+ on the App Store and is intended for users 18 or older. By using the app you confirm you meet this age requirement.
Photos you submit
When you use a photo to get an AI estimate, you grant Ihor Baranov a non-exclusive, worldwide, royalty-free licence to transmit and process that photo solely to provide the estimate back to you, as described in the Privacy Policy. We do not use your photos for any other purpose and do not claim ownership of them.
No warranty
Nyamly is provided "as is" and "as available," without warranty of any kind, to the maximum extent permitted by law. We do not warrant that the app will be uninterrupted, error-free, or that any data or estimate shown is accurate. Nothing in this section limits any right you have as a consumer under the law of your country of residence, which this section does not affect or reduce (see "Your consumer rights" below).
Limitation of liability
To the maximum extent permitted by law, Ihor Baranov's total liability to you for any claim arising from your use of Nyamly is limited to the greater of (a) the amount you paid for Nyamly Pro in the 12 months before the claim, or (b) US$50. This limit does not apply to liability that cannot be limited by law, including liability for death, personal injury, or fraud, and does not affect your consumer rights described below.
Indemnity
If a third party makes a claim against us because of content you submitted (such as a photo) or because you used Nyamly unlawfully, you agree to indemnify us for the resulting direct losses, to the extent caused by that submission or unlawful use and to the extent permitted by the law of your country of residence. We will tell you promptly about any such claim and will not settle it without consulting you first. This does not apply to claims arising from our own breach of these terms or from Nyamly working as intended.
Your consumer rights
If you are a consumer, nothing in these terms excludes or limits any right you have under the mandatory consumer-protection law of your country or state of residence that cannot lawfully be excluded or limited by agreement — including rights under EU/UK consumer law, German or French law, Ontario's or Québec's consumer protection legislation, or Brazil's Código de Defesa do Consumidor. Where a clause in these terms would otherwise conflict with such a right, that clause applies only to the extent the law allows, and the rest of these terms remains in effect.
Governing law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-law rules. This does not deprive you of the protection of any mandatory provisions of the law of the country in which you live. Any dispute may be brought in the courts of Ontario, Canada, or in the courts of your own country or state if the law there gives you that right; this is a non-exclusive choice of venue and does not require you to sue or be sued in Ontario.
Termination
You may stop using Nyamly and delete the app at any time. We may suspend or end your access to the app's online features (such as barcode search or AI estimates) if you seriously or repeatedly violate the Acceptable Use section above. This does not affect any subscription you have already paid for, which is handled by Apple under its own refund policy.
Apple's Licensed Application End User License Agreement
If you downloaded Nyamly from the App Store, Apple's standard End User License Agreement also applies and covers matters including your licence to use the app, restrictions on reverse engineering, export compliance, and Apple's role as a third-party beneficiary of this agreement (apple.com/legal/internet-services/itunes/dev/stdeula). Where these terms and Apple's standard EULA cover the same subject, Apple's standard EULA governs for matters it specifically addresses (such as the licence grant and its own liability cap); these terms govern everything else, including the sections above. Apple is not responsible for Nyamly or its content. Refunds for App Store purchases are handled by Apple, not by us — see Apple's own refund process.
Changes
These terms may change as the app evolves. The "last updated" date above reflects the current version.
